Terms and Conditions

General Terms

These Terms & Conditions (including GamePlaza’s Privacy Policy) are a contract between you and GamePlaza (referred to in these Terms & Conditions as “GamePlaza”, “us”, “we” or “our”), the provider of the GamePlaza Services.

The Terms & Conditions apply to the visit of our website, the opening of an account, the purchase of admission tickets, birthday packages and company events as well as all other GamePlaza Services. The contract is concluded with GamePlaza by a confirmatory e-mail or other appropriate means of communication by GamePlaza.

You confirm that you are in agreement with and bound by the terms of service contained in the Terms & Conditions outlined below along with GamePlaza’s Privacy Policy. These Terms & Conditions and the Privacy Policy apply to the entire website, the GamePlaza Services and any email or other type of communication between you and GamePlaza.

You are agreeing to be bound by these Terms & Conditions and GamePlaza’s Privacy Policy. If you do not agree to these Terms & Conditions and/or GamePlaza’s Privacy Policy, please do not use the GamePlaza Services. In these Terms & Conditions, “you” refers both to you as an individual and to the entity you represent. If you violate any of these Terms & Conditions, we reserve the right to cancel your account or block access to your account and/or the GamePlaza Services without notice.

 

Definitions and key terms

To help explain things as clearly as possible in this Terms & Conditions, every time any of these terms are referenced, are strictly defined as:

  • Cookie: small amount of data generated by a website and saved by your web browser. It is used to identify your browser, provide analytics, remember information about you such as your language preference or login information.
  • Company: when this terms mention “Company”, we, us, or our, it refers to GamePlaza GmbH, Badenerstrasse, 8048 Zürich, Switzerland, that is responsible for your information under this Terms & Conditions.
  • Country: where GamePlaza or the owners/founders of GamePlaza are based, in this case is Switzerland
  • Device: any internet connected device such as a phone, tablet, computer or any other device that can be used to visit GamePlaza and use the services.
  • Museum: the venue of GamePlaza at Badenerstrasse 569, 8048 Zürich, Switzerland.
  • GamePlaza Services: refers to the services provided by GamePlaza as described in these Terms & Conditions, accessible from the GamePlaza website and/or the Museum (as well as the services to which it connects.
  • Third-party service: refers to advertisers, contest sponsors, promotional and marketing partners, and others who provide our content or whose products or services we think may interest you.
  • Website: GamePlaza’s site, which can be accessed via this URL: https://gameplaza.ch/
  • You: a person or entity that is registered with GamePlaza to use the Services.

 

Payment

Admission tickets, birthday packages and company events purchased in advance are only valid for the time booked and stated in the purchase confirmation. The Museum cannot be entered before or after the booked time. No access to the Museum can be guaranteed without prior booking.

If you pay for any of our one-time payment services, you agree to pay all fees or charges to your account for the GamePlaza Services in accordance with the fees, charges and billing terms in effect at the time that each fee or charge is due and payable. Your Payment Provider agreement governs your use of the designated credit, debit card or TWINT account, and you must refer to that agreement and not these Terms to determine your rights and liabilities with respect to your Payment Provider. By providing GamePlaza with your credit/debit card number or TWINT and associated payment information, you agree that GamePlaza is authorized to verify information immediately, and subsequently invoice your account for all fees and charges due and payable to GamePlaza hereunder and that no additional notice or consent is required. You agree to immediately notify GamePlaza of any change in your billing address or the credit/debit card used for payment hereunder. GamePlaza reserves the right at any time to change its prices and billing methods, either immediately upon posting on our Site or by e-mail delivery to your organization’s administrator(s).

You are responsible for any third-party fees that you may incur when using the GamePlaza Services.

 

Return and Refund Policy

If you do not arrive on time, we reserve the right to give your place in the Museum to other visitors 10 minutes after the reservation start time. If you inform us by phone of your delay, your reservation will be kept for you.

Refunds of the purchase amount are excluded on entry tickets; vouchers for GamePlaza will be issued in all cases. Postponements or cancellations of events such as company packages or birthday packages requires a minimum of one week notice before the booking date and are free of charge. Up to 6 days before the event booking date,50%% of the purchase amount will be charged and 48 hours before the booking date, 100% will be charged.. Cancellations must be made by email to info@gameplaza.ch.

Refund is not possible for complaints from a Visitor regarding: the non-visibility of objects from the Museum’s permanent collection; psychological consequences of seeing objects that are experienced as shocking by the Visitor; the partial closure of the Museum building, including, but not limited to, partial closure due to the construction or dismantling of exhibitions; an adjustment of the regular opening hours in connection with exercises in the context of company emergency response or a calamity; nuisance or inconvenience caused by other Visitors due to, among other things, noise pollution, inappropriate behaviour, theft and molestation; nuisance or inconvenience caused by maintenance work on, or a renovation or (re)design of, the Museum building; nuisance or inconvenience caused by the improper functioning of facilities in the Museum building; nuisance or inconvenience caused by (large) crowds; subsequent demonstration of possession of a discount card, after purchasing an Entrance Ticket; nuisance in the vicinity of the Museum due to work, activities or road closures by third parties.
If, for any reason, you are not completely satisfied with any good or service that we provide, don’t hesitate to contact us and we will discuss any of the issues you are going through with your ticket or package.

This Terms & Conditions applies only to the GamePlaza Services. The GamePlaza Services may contain links to other websites not operated or controlled by GamePlaza. We are not responsible for the content, accuracy or opinions expressed in such websites, and such websites are not investigated, monitored or checked for accuracy or completeness by us. Please remember that when you use a link to go from the GamePlaza Services to another website, our Terms & Conditions are no longer in effect. Your browsing and interaction on any other website, including those that have a link on our platform, is subject to that website’s own rules and policies. Such third parties may use their own cookies or other methods to collect information about you.

 

Cookies

GamePlaza uses “Cookies” to identify the areas of our website that you have visited. A Cookie is a small piece of data stored on your computer or mobile device by your web browser. We use Cookies to enhance the performance and functionality of our website but are non-essential to their use. However, without these cookies, certain functionality like videos may become unavailable or you would be required to enter your login details every time you visit the website as we would not be able to remember that you had logged in previously. Most web browsers can be set to disable the use of Cookies. However, if you disable Cookies, you may not be able to access functionality on our website correctly or at all. We never place Personally Identifiable Information in Cookies.

 

Changes To Our Terms & Conditions

You acknowledge and agree that GamePlaza may stop (permanently or temporarily) providing the GamePlaza Services (or any features within the GamePlaza Services) to you or to users generally at GamePlaza’s sole discretion, without prior notice to you. You may stop using the GamePlaza Services at any time. You do not need to specifically inform GamePlaza when you stop using the GamePlaza Servicse. You acknowledge and agree that if GamePlaza disables access to your account, you may be prevented from accessing the GamePlaza Services, your account details or any files or other materials which is contained in your account.

If we decide to change our Terms & Conditions, we will post those changes on this page, and/or update the Terms & Conditions modification date below.

 

Modifications to Our website

GamePlaza reserves the right to modify, suspend or discontinue, temporarily or permanently, the website or any GamePlaza Services to which it connects, with or without notice and without liability to you.

 

Updates to Our website

GamePlaza may from time to time provide enhancements or improvements to the features/ functionality of the website, which may include patches, bug fixes, updates, upgrades and other modifications (“Updates”).

Updates may modify or delete certain features and/or functionalities of the website. You agree that GamePlaza has no obligation to (i) provide any Updates, or (ii) continue to provide or enable any particular features and/or functionalities of the website to you.

You further agree that all Updates will be (i) deemed to constitute an integral part of the website, and (ii) subject to the Terms & Conditions of this Agreement.

 

Third-Party Services

We may display, include or make available third-party content (including data, information, applications and other products services) or provide links to third-party websites or services (“Third- Party Services”).

You acknowledge and agree that GamePlaza shall not be responsible for any Third-Party Services, including their accuracy, completeness, timeliness, validity, copyright compliance, legality, decency, quality or any other aspect thereof. GamePlaza does not assume and shall not have any liability or responsibility to you or any other person or entity for any Third-Party Services.

Third-Party Services and links thereto are provided solely as a convenience to you and you access and use them entirely at your own risk and subject to such third parties’ terms and conditions.

 

Indemnification

You agree to indemnify and hold GamePlaza and its parents, subsidiaries, affiliates, officers, employees, agents, partners and licensors (if any) harmless from any claim or demand, including reasonable attorneys’ fees, due to or arising out of your: (a) use of the website and/or the GamePlaza Services; (b) violation of this Agreement or any law or regulation; or (c) violation of any right of a third party.

 

No Warranties

The website is provided to you “as is” and “as available” and with all faults and defects without warranty of any kind. To the maximum extent permitted under applicable law, GamePlaza, on its own behalf and on behalf of its affiliates and its and their respective licensors and service providers, expressly disclaims all warranties, whether express, implied, statutory or otherwise, with respect to the website, including all implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and warranties that may arise out of course of dealing, course of performance, usage or trade practice. Without limitation to the foregoing, GamePlaza provides no warranty or undertaking, and makes no representation of any kind that the website and/or the GamePlaza Services will meet your requirements, achieve any intended results, be compatible or work with any other software, websites, systems or services, operate without interruption, meet any performance or reliability standards or be error free or that any errors or defects can or will be corrected.

Without limiting the foregoing, neither GamePlaza nor any GamePlaza’s provider makes any representation or warranty of any kind, express or implied: (i) as to the operation or availability of the website and/or the GamePlaza Services, or the information, content, and materials or products included thereon; (ii) that the website and/or the GamePlaza Services will be uninterrupted or error-free; (iii) as to the accuracy, reliability, or currency of any information or content provided through the website and/or the GamePlaza Services; or (iv) that the website, its servers, the content, or e-mails sent from or on behalf of GamePlaza are free of viruses, scripts, trojan horses, worms, malware, timebombs or other harmful components.

 

Limitation of Liability

Notwithstanding any damages that you might incur, the entire liability of GamePlaza and any of its suppliers under any provision of this Agreement and your exclusive remedy for all of the foregoing shall be limited to the amount actually paid by you for the website and/or the GamePlaza Services.

To the maximum extent permitted by applicable law, in no event shall GamePlaza or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever (including, but not limited to, damages for loss of profits, for loss of data or other information, for business interruption, for personal injury, for loss of privacy arising out of or in any way related to the use of or inability to use the website, the GamePlaza Services, third-party software and/or third-party hardware used with the website and/or the GamePlaza Services, or otherwise in connection with any provision of this Agreement), even if GamePlaza or any supplier has been advised of the possibility of such damages and even if the remedy fails of its essential purpose.

The use of the GamePlaza Services  at the Museum by a visitor or their guests is at their own risk. It cannot be ruled out that by visiting GamePlaza and using/playing the (video game) machines may cause dizziness, cramps, blackouts, nausea, visual disturbances, eye pain, disorientation and loss of consciousness, headaches and even epileptic seizures. If you have any known pre-existing medical conditions, you are advised not to use the (video game) machines at the Museum. If you experience any of the following during use, please contact the GamePlaza representative. GamePlaza’s employees are entitled to immediately interrupt or prevent further use at the first signs of the impairments described. GamePlaza is not recommended for the following groups of people: pregnant women, people with heart failure, people with serious illnesses, people with serious mental illnesses, people prone to seizures and epilepsy, people who are physically and/or mentally sensitive to fast sequences of images, fast movements or electrical voltage fields. GamePlaza also reserves the right to exclude people from use of the the GamePlaza Services in individual cases. This is particularly the case if; people are under the influence of alcohol or have taken other mind-altering substances, people behave loudly despite repeated warnings and thereby disturb other visitors, people behave aggressively, xenophobically, provocatively or in any other way inappropriately towards the staff or other guests. In the cases described, no refund or partial refund will be made due to restricted or non-use. If one or more of the above restrictions apply, the user must inform GamePlaza’s employees. Same applies to known phobias or other problems If minors are using the services, an adult should be involved. Ideally, this is an adult with parental responsibility who approves the usage of the (video game) machines of the minor. The adult therefore assumes full responsibility for use at their own risk. GamePlaza will indicate as well provide age rating per machine to ensure the proper decision can be made by the user/visitor. The operator advises all parents and accompanying persons of groups to carefully fulfill their duty of supervision, as we cannot release them from this. In this context, supervisors and parents are also responsible for all damage caused by those under their supervision.

 

Amendments to this Agreement

GamePlaza reserves the right, at its sole discretion, to modify or replace this Agreement at any time. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our website and/or the GamePlaza Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the GamePlaza Services.

 

Entire Agreement

These Terms & Conditions (including GamePlaza’s Privacy Policy)  constitute the entire agreement between you and GamePlaza regarding your use of the website and/or the GamePlaza Services and supersedes all prior and contemporaneous written or oral agreements between you and GamePlaza.

You may be subject to additional terms and conditions that apply when you use or purchase the GamePlaza Services, which GamePlaza will provide to you at the time of such use or purchase.

 

Updates to Our Terms

We may change our Terms & Conditions, and we may need to make changes to these Terms & Conditions so that they accurately reflect our GamePlaza Services and policies. Unless otherwise required by law, we will notify you (for example, through our GamePlaza Services ) before we make changes to these Terms & Conditions and give you an opportunity to review them before they go into effect. Then, if you continue to use the website and/or the GamePlaza Services, you will be bound by the updated Terms & Conditions. If you do not want to agree to these or any updated Terms & Conditions, you can delete your account.

 

Intellectual Property

The website and/or the GamePlaza Services and its entire contents, features and functionality (including but not limited to all information, software, text, displays, images, video and audio, and the design, selection and arrangement thereof), are owned by GamePlaza, its licensors or other providers of such material and are protected by Switzerland and international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws. The material may not be copied, modified, reproduced, downloaded or distributed in any way, in whole or in part, without the express prior written permission of GamePlaza, unless and except as is expressly provided in these Terms & Conditions. Any unauthorized use of the material is prohibited.

 

Promotions

GamePlaza may, from time to time, include contests, promotions, sweepstakes, or other activities (“Promotions”) that require you to submit material or information concerning yourself. Please note that all Promotions may be governed by separate rules that may contain certain eligibility requirements, such as restrictions as to age and geographic location. You are responsible to read all Promotions rules to determine whether or not you are eligible to participate. If you enter any Promotion, you agree to abide by and to comply with all Promotions Rules.

Additional terms and conditions may apply to purchases of goods or services on or through the GamePlaza Services, which terms and conditions are made a part of this Agreement by this reference.

 

Typographical Errors

In the event a product and/or service is listed at an incorrect price or with incorrect information due to typographical error, we shall have the right to refuse or cancel any orders placed for the product and/or service listed at the incorrect price. We shall have the right to refuse or cancel any such order whether or not the order has been confirmed and your credit/debit card or TWINT charged. If your credit/debit card or TWINT has already been charged for the purchase and your order is canceled, we shall immediately issue a credit to your credit/debit card or TWINT account or other payment account in the amount of the charge.

 

House Rules

  1. Video surveillance, Theft and Vandalism

Within the premises of the Museum there is video surveillance. The videos are automatically deleted after one month, unless theft or vandalism applies and the videos are used as evidence. Theft or vandalism will be reported to the authorities and will also result in a ban from the premises.

  1. Food & Drinks Consumption

No drinks or food are allowed to be consumed at the main Museum floor. Consumption is allowed in the foyer or birthday party area when obtained or purchased on GamePlaza’s ground. Consuming drinks or food brought in by yourself is prohibited in the entire museum, with exception of a birthday cake brought for birthday party celebration in combination with a birthday table reservation.

  1. Photo(s) and video recording(s)

Taking photo(s) and video recording(s) for non-commercial purposes is/are allowed in the Museum provided you have consent of all person(s) visible in the photo(s) or video recording(s). Recordings and images may only be made in the Museum building for commercial purposes with the written permission of the Museum.

  1. Pets

No animals are allowed on the premises of the Museum. Except registered assistance dogs.

  1. Visitors under the age of ten

Visitors under the age of ten may only visit the Museum Building if accompanied by an adult. Parents and guardians are fully responsible and liable for the behaviour of the aforementioned Visitors under the age of ten.

  1. Guardians of Groups

i) Guardians of groups are fully responsible and liable for the behaviour of the Group they are guiding. They must guide the Groups during the visit to the Museum building and comply with the instructions of the Official.

ii) At least one adult guardian must be present for each Group with a size of up to fifteen pupils/children. The Museum may refuse access to Groups that do not meet the number of guardians prescribed

  1. Violation of House Rules

If a Visitor repeatedly acts in violation of the Visitor Conditions or directions and instructions given by the Official, the Museum may deny him/her access to the Museum Building for a certain period of time. A decision to deny access to the Museum Building will be announced to the Visitor by the Museum, without the Visitor being entitled to reimbursement of the costs of the Entrance Ticket or any other costs incurred.

 

Miscellaneous

If for any reason a court of competent jurisdiction finds any provision or portion of these Terms & Conditions to be unenforceable, the remainder of these Terms & Conditions will continue in full force and effect. Any waiver of any provision of these Terms & Conditions will be effective only if in writing and signed by an authorized representative of GamePlaza. GamePlaza will be entitled to injunctive or other equitable relief (without the obligations of posting any bond or surety) in the event of any breach or anticipatory breach by you. GamePlaza operates and controls the GamePlaza Services from its offices in Switzerland. The GamePlaza Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation. Accordingly, those persons who choose to access the GamePlaza Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

Swiss law applies exclusively. The place of jurisdiction for all disputes is Zurich.
